By accessing this website (“Website”), you acknowledge that you have read, understood and accepted these Terms of Use (“Terms”). These terms govern the use of this Website and your use of the your use of the playtest version of our “e-Cricket” game ("Playtest"), which is exclusively developed and owned by LeagueX Gaming Private Limited (“Lightfury Games"). If you do not agree to these Terms, you are requested by LeagueX Gaming Private Limited not to access the Website or download any materials from the Website (including the Playtest). Your continued use of / access to the Website or downloading any material available on the Website, including the Playtest, will be construed as your acceptance of these Terms. Lightfury Games reserves the right to make modifications, changes and alterations to the contents of this Website, including these Terms, at any time without any prior notice..
Lightfury Games does not represent that the contents or materials available at this site are appropriate or available for use in your country and access to them from territories where their contents are illegal, is prohibited. You are responsible for compliance with all the applicable local laws.
Right to Use the Website:
Lightfury Games only grants you a non-exclusive, non-transferable, limited right to access, use and display to this Website and the materials thereon only for personal and informational purpose.
Permission to use documents (such as blogs, press releases, articles and other publications) that can be downloaded from this Website is granted by Lightfury Games, provided that, (1) Lightfury Games’ copyright notice appears in all the copies of documents, (2) Use of such documents from this Website is for informational and non-commercial use only and will not be copied or posted on any network computer or broadcast in any media, format or on any platform, and (3) No modifications of any documents are made by the user or any other person. Any unauthorized use is expressly prohibited by law and may result in severe civil and criminal penalties.
The documents specified above do not include the design, colours, look and feel or layout of this Website. Elements of this Website are protected by trade dress and other laws and may not be copied or imitated in whole or in part. No logo, graphic, sound or image from this Website may be copied or used or retransmitted unless expressly permitted by Lightfury Games.
Playtest:
These Terms govern your use of the Playtest, which is exclusively developed and owned by Lightfury Games. If you do not agree, you must not access, use, or download the Playtest. Your continued use will be considered your binding acceptance of these Terms.
Lightfury Games grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Playtest solely for your personal, non-commercial purpose of testing the e-Cricket game and providing us with valuable feedback. All rights not expressly granted to you are reserved by Lightfury Games. The primary purpose of your participation is to provide feedback on the Playtest. You agree that any feedback you provide, including bug reports, suggestions, comments, and ideas, becomes the exclusive property of Lightfury Games. We have the unrestricted right to use, modify, and implement your feedback without any obligation or compensation to you.
This Playtest may display the likenesses of real-world individuals, athletes, commentators, stadiums. You acknowledge that these likenesses are being used for the limited and confidential purpose of testing only. Their inclusion does not imply any endorsement or affiliation with Lightfury Games, and we have not represented that we have secured all necessary licenses. Lightfury Games is in the process of obtaining all required licenses for the final launch of e-Cricket game. Any likenesses present in this Playtest that are not covered by a license for the final commercial launch will be removed or altered. You agree not to use, reproduce, or share any of these likenesses outside of the Playtest. You understand that any such action is a material breach of these Terms and may expose you to legal action for infringement upon a third party's rights. You also agree to promptly and fully indemnify Lightfury Games for any and all damages, claims, or costs arising from your unauthorized use of these likenesses. This Playtest contains fictional brand names, team names, logos, and other in-game content. You acknowledge that these elements are fictitious and are for testing purposes only. They bear no resemblance to any real-world brands, teams, products, or persons, living or dead. Any similarity is entirely coincidental and unintentional. You are strictly prohibited from copying, using, or claiming any rights to this fictional content, and you understand that its use is limited to the confidential Playtest environment. You agree that any unauthorized use or public dissemination of this content is a violation of these Terms.
Lightfury Games makes no representation that the Playtest is appropriate or available in your country. Access from territories where its contents are illegal is prohibited. You are solely responsible for compliance with all applicable local laws.
The Playtest may link to or be hosted on third-party servers. Your access is at your own risk. Lightfury Games is not responsible for any third-party content, nor do we endorse it. Your use of these third-party services is subject to their own terms and conditions.
Intellectual Property Rights:
This Website, including its design, layout, source code, interactive elements, databases, user interfaces, all visual and audio elements (including but not limited to trailers, teasers, cinematics, music, sound effects, character designs, game environments, and in-game assets), graphics, written content and all the material present (excluding any third party materials) is exclusive property of Lightfury Games and protected by copyright laws (“Website IP”). Copying, reproducing in whole or in part or creating derivative works in any form or medium, without express written permission is prohibited. Lightfury Games does not grant any express or implied rights under any patents, trademarks, copyrights, trade secret information or any other intellectual property rights.
Lightfury Games’ logo is the registered trademark of Lightfury Games and protected by trademark laws. Lightfury Games and the names of Lightfury Games’ products referenced herein are trademarks of Lightfury Games. Other products and company names mentioned herein may be trademarks and/or service marks of their respective owners and are acknowledged as such without prejudice.
The Website IP, Playtest, along with all its elements and features, is the exclusive intellectual property of LightFury Games ("LFG IP"). This LFG IP is our confidential and proprietary information. LFG IP includes, without limitation, all aspects of our game design and development, regardless of form or registration. This includes without limitation:
a) The software, source code, algorithms, architecture, development tools and proprietary technologies and other technical information.
b) All designs, layouts, visual and audio elements, graphics, characters, environments, in-game assets, and the overall look and feel.
c) Game concepts and designs including storylines, character designs, game mechanics, level designs, features, game environment, look and feel of the game, nature of the game and user interface/user experience (UI/UX) specifications, levels, game modes, player modes, historical data, broadcast styles, broadcast method, game physics.
d) Art and Audio Assets including concept art, 3D models, animations, colours, look and feel, sound effects, music, and voice recordings, teasers, videos, animations, stadium art, marketing videos and assets.
e) Moral rights, database rights, utility models or other intellectual property rights.
f) All confidential and proprietary data and information related to our game projects, including game concepts, business plans, internal processes, and data analytics.
g) Our registered and unregistered trademarks, logos, and brand names, including "LightFury," "LightFury Games," "LightFury Studios," and "e-Cricket" (including all variations thereof) (“Brand Content”).
Restrictions and Prohibitions
Your access is for confidential testing only. You are strictly prohibited from, and shall not permit any third party to:
a) Creating, copying, reproducing, or distributing any part of the Playtest. This includes, but is not limited to, taking screenshots, screen recordings, photographs, or using any other screen capture or recording tools.
b) Broadcasting, streaming, transmitting, or sharing any portion of the Playtest on any public platform, social media, or via any medium whatsoever, including live streams, videos, or static images.
c) Modifying, adapting, translating, or creating works based on the Playtest. You shall not reverse-engineer, decompile, deconstruct, disassemble, or otherwise attempt to discover the source code, trade secrets, or underlying structure of the Playtest.
d) Creating, developing, or assisting in the creation or development of any game, product, or service that is derived from, based on, or imitates the Playtest, its game mechanics, art assets, or concepts.
e) Verbally or in writing, disclosing, summarizing, or describing any element of the Playtest, its operation, features, or content to any unauthorized person. This includes, but is not limited to, concept ideas, storyline, gameplay design, character details, level layouts, or unreleased features, regardless of whether the information is publicly available.
f) Disclosing the identity of any other tester or user of the Playtest to any third party.
Any unauthorized use or violation of Clause “Restrictions and Prohibitions” constitutes a material breach of these Terms and may subject you to severe legal penalties.
Duty of Care
You are required to hold the Playtest and LFG IP in strictest confidence. You must treat the Playtest and LFG IP with the same degree of care they use to protect their own confidential information, but in no event less than a reasonable degree of care. You are responsible for any unauthorized disclosure or use of the Playtest and LFG IP while it is in their possession or under their control.
No Implied Rights or Licenses
Nothing in these Terms shall be construed as granting you any rights, title, or interest in or to the Playtest or any LFG IP. You are not granted any express or implied licenses to any of the LFG IP, other than the limited, non-commercial use expressly permitted by these Terms.
Return or Destruction of Information
Upon the termination of the Playtest or upon the Company's request, you must immediately cease all use of the LFG IP. You must also destroy or permanently delete all copies of the Playtest, its files, documentation, and any other LFG IP from their computer systems, storage devices, and all other media. You shall certify in writing that all such materials have been destroyed or deleted as required
Third Party Content:
The Website may make information or material of third parties available (“Third Party Content”). By accessing such Third Party Content, you may leave this Website and be directed to an external website that is not maintained by Lightfury Games. Any access or use of such third party website by you shall be at your own risk and responsibility. Also, Website may provide links to third party sites. These linked sites are not under the control of Lightfury Games and Lightfury Games is not responsible for the contents of any linked site or any link contained in a linked site. Lightfury Games provides links to you only for your convenience, and the inclusion of any link does not imply endorsement by Lightfury Games of the site. Lightfury Games makes no warranty or representation and does not endorse any such Third Party Content
The Website is hosted on a third party server and any use of or access of the Website by you shall be governed by the terms and conditions applicable to the use of such third party server in addition to these Terms.
No Warranties:
ALL THE INFORMATION AND MATERIAL AVAILABLE ON THIS WEBSITE IS PROVIDED ON “AS IS” BASIS WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES OR REPRESENTATIONS OF ANY KIND. LIGHTFURY GAMES HEREBY EXPRESSLY DISCLAIMS, TO THE FULLEST EXTENT PERMITTED BY LAW, ALL EXPRESS, IMPLIED, STATUTORY OR OTHER WARRANTIES OR REPRESENTATIONS, INCLUDING WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF NON- INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
While all the documents and graphics included in the Website are factual and true, Lightfury Games and/or its respective partners make no representations about the suitability of the information contained in the documents and related graphics published on this Website for any purpose.
Lightfury Games does not guarantee or warrant that files available for downloading from this Website will be free of infection or viruses, worms, Trojan horses or other codes that manifest contaminating or destructive properties. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for accuracy of data input and output, and for maintaining a means external to the Website for the reconstruction of any lost data.
THE PLAYTEST IS PROVIDED "AS IS" AND "AS AVAILABLE". Lightfury Games makes no warranties, representations, or guarantees of any kind, whether express, implied, statutory, or otherwise, including without limitation the implied warranties of non-infringement, merchantability, accuracy, completeness or fitness for a particular purpose. You acknowledge and agree that the Playtest is a pre-release version of the game and is expected to contain defects, errors, and incomplete features. Lightfury Games does not warrant that the Playtest will be uninterrupted, secure, or free of errors, free of malicious code. You assume all risks associated with the use of the Playtest, including the risk of data loss, system failure, or any other damages that may arise. You are solely responsible for protecting your own systems and for backing up any data.
Indemnity & Limitation of Liability:
You agree to indemnify, defend and hold harmless Lightfury Games, its subsidiaries and affiliates from any claim, cost, expense, judgment, damages or other loss arising out of or in relation to your use of this Website and/or the Playtest in any manner.
The entire risk arising out of the use of this Website, its contents or material downloaded there from, remains with the user. In no event shall Lightfury Games be liable for any direct, indirect, consequential, incidental, special, punitive or other damages whatsoever (including without limitation, damages for loss of business profits, business interruption, or loss of business information), arising out of or in connection with your use or access to the Website (including without limitation non-availability of the Website) even if Lightfury Games has been advised of the possibility of such damages.

Laws & Jurisdiction:
These Terms shall be governed by the laws of India, without giving effect to its conflict of laws provisions. Any dispute arising out of or in relation these Terms shall be subject to the exclusive jurisdiction of courts at Bengaluru, Karnataka India.
